Terms of Use

These Terms of Use are effective as of October 13, 2025

Contractual Relationship

‍

These Terms of Use (“TOU”) govern your access to and use of the evntstack.com and eventtechstack.com websites, and related websites, online services and content, and mobile applications (collectively, “Services”) provided by Event Tech Stack, LLC, or any parent, subsidiary or affiliate thereof (collectively, “ETS”). PLEASE READ THESE TOU CAREFULLY, AS IT IS A LEGAL AGREEMENT BETWEEN YOU AND ETS.

The Services allow you to register for and participate in live streaming, recorded, and in-person events (each an “Event”) organized by the users (each an “Event Organizer”) of ETS’s online event management platform (“Platform”).

By accessing or using the Services, you confirm your agreement to be bound by these TOU. If you do not agree to these TOU, you may not access or use the Services.

‍

ETS may amend these TOU from time to time, effective upon ETS’s posting of the updated TOU at this location. Your continued access or use of the Services after such posting confirms your consent to be bound by these TOU, as amended.

ETS reserves the right, in its sole and absolute discretion, at any time and for any reason, with or without prior notice, to (a) modify, suspend, or discontinue all or any portion of the Services, or goods or services offered on or through the Services, including the features, look and feel, functional elements, and related items, or (b) terminate your access to and use of the Services.

Privacy Policy

‍

ETS’s collection and use of personal information when you use the Services is described in ETS’s privacy policy (“Privacy Policy”) located at eventtechstack.com/privacy-policy, which is incorporated by reference into these TOU.

‍

Ownership

‍

The Services, and all rights therein, and all Materials are and shall remain the property of ETS or its licensors, or if applicable the Event Organizer. “Materials” means all materials available on or through the Services, including (i) live stream or recorded Events, and (ii) all data, text, photos, videos, graphics, logos, software, or other content. No Materials may be copied, republished, uploaded, posted, transmitted, distributed in any way, or modified (including removal or alteration of any proprietary rights or attribution notices). The Services and Materials are protected by copyright, trademark, trade dress, patent, trade secret, domain name, international treaties, and other proprietary rights, and laws of the United States and other countries. Except as expressly provided in these TOU, no right or license is granted to you in or to the Services or Materials, or to use ETS’s or its licensors’ company name, brands, logos, product and service names, trademarks, or Services marks.

Access Rights

‍

ETS grants you a non-exclusive, non-transferable, non-sublicensable, revocable right to access and use the Services and Materials, subject to any applicable limitations or other terms stated herein or on the Services, solely for your internal business or personal purposes. The foregoing is a license and not an agreement for sale.

Use Restrictions

‍

You may not:

‍

• remove any copyright, trademark, or other proprietary notices from any portion of the Services or Materials;
• reproduce, copy, modify, prepare derivative works based upon, distribute, license, lease, sell, resell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the Services or Materials;
• decompile, reverse engineer, or disassemble the Services or Materials, or otherwise reduce the software or Materials to a human-perceivable form for any purpose, including without limitation to build a product or service competitive with the Services or Materials, except as may mandated to be permitted by applicable law without the option of opting out of such permission;
• deep link to, mirror, or frame any portion of the Services or Materials;
• other than for indexing by a bona fide search engine which does not otherwise violate these TOU, cause or launch any robot, spider, web crawler, extraction software, device, program or scripts for the purpose of monitoring, scraping, indexing, surveying, or otherwise data mining any portion of the Services or Materials, or unduly burdening or hindering the operation or functionality of any aspect of the Services or Materials;
• attempt, through any means, to gain unauthorized access to, or to overburden or disable, any part of the Services, other account, computer system or network connected to any ETS owned, shared, or leased server;
• upload or transmit viruses or other harmful, disruptive, or destructive files or malicious code;
• disrupt, interfere with, or otherwise harm or violate the security of the Services, system resources, registrations, servers or networks connected to or accessible through the Services, or affiliated or linked sites;
• combine the Services or Materials with any other data or information for the purpose, or with the result, of determining the identity or other personal information of any person; or
• otherwise violate the letter or spirit of these TOU.

Conduct Restrictions

‍

You agree to comply with all applicable laws regarding online conduct and submission of acceptable user content when accessing or using the Services. In accessing or using the Services, you may not cause nuisance, annoyance, inconvenience, or property damage to any other party. Without limiting the foregoing, by accessing the Services you agree:

• not to use the Services for any illegal purposes;
• not to conduct any kind of systematic collection of data or other content (whether automated or manual) from the Services or its users;
• not to interfere with any other party’s use and enjoyment of the Services;
• not to harass, annoy, intimidate, or threaten any other users or ETS employees or agents;
• not to sell or transfer your registration;
• not to let others use your registration to access the Services;
• not to access the Services using a third-party’s registration;
• not to attempt to impersonate another user or person;
• if you are under the age of 13, not to use the Services or submit content to the Services, and if you are under the age of 18, not to use the Services or submit content to the Services without the permission of your parent or guardian;
• not to use the Services to engage in commercial activities;
• not to advertise or solicit any user to buy or sell any products or services;
• not to use the Services as part of an effort to compete with ETS or the Services; and
• not to transmit any chain letters or junk email.

Violations of Use and Conduct Restrictions

‍

You agree that violations of the foregoing use and conduct restrictions may be so serious and incalculable that monetary compensation will not be a sufficient or appropriate remedy, and that ETS will be entitled to temporary and permanent injunctive relief to prohibit such use or activity, without the need to prove damages or to post bond.

You hereby indemnify and hold harmless ETS from and against any and all claims, allegations, demands, suits, and proceedings (collectively, “Claims”), and from and against any liability, judgments, awards, damages, settlements, fees, and costs (including attorney’s fees) (collectively, “Damages”) incurred in connection with any such Claims, brought or asserted by any third party arising out of or relating to your violation of the foregoing use and conduct restrictions.

Events and Event Organizers

‍

The Services allow you to participate in Events organized by Event Organizers, including live streaming, recorded, and in-person Events. Events are conducted by the respective Event Organizer, not by ETS. ETS is a platform and service provider only. ETS is not responsible in any way for the Events conducted by Event Organizers, using the Platform or in-person, or for any activities at Events. ETS has no obligation to review, edit, allow, disallow, approve, disapprove, or otherwise monitor activities that take place at, or content that is included in, any Event. ETS is not, and should not be regarded as, a publisher. Event Organizers are not authorized ETS spokespersons and their views are not necessarily those of ETS.

Events may be recorded. By participating in an Event, you consent to such recording. If you do not consent to being recorded, you may not participate in the Event.

ETS is not responsible or liable for the availability of any Event, or your ability to participate in it, including if the Event is cancelled or rescheduled. You hereby waive any Claims, and hereby release and hold ETS harmless from and against any Claims, and Damages incurred in connection with any such Claims, arising out of or relating to any Event you attend, or any activities at Events.

Email and Text Message Notifications and Messages

‍

If you have consented, or in the future consent, to receive notifications or other information via text/SMS or email, this section applies. You are not required to provide consent as a condition of purchasing any property, goods, or services. You may opt out of receiving SMS or MMS marketing messages from ETS at any time, either by replying to a text message sent with the word STOP using the mobile device that is receiving the messages, or by contacting help@evntstack.com. If you do not choose to opt out, ETS may contact you in accordance with the Privacy Policy. For all Text/SMS messages and telephone calls, data and calling rates may apply. You may opt out of receiving email marketing messages from ETS at any time by following the instructions in the email message.

You agree that ETS may confirm or verify your registration by sending you by an email message to the email address you provide in connection with creating and maintaining your registration. You hereby consent to receiving (a) any such communications we may send you for our administrative and operational purposes in accordance with the Privacy Policy, and (b) notifications we may send you using the Services.

Payments

‍

If you use Services which require payment by you, ETS’s third-party payment processor, or the Event Organizer or its payment processor, will process any payments using the payment information you provide to it, and their terms of use and privacy policies apply to their use of your personal information. The Event Organizer, not ETS, is responsible for processing refunds, if any, based on its refund policy. If you have questions about a possible refund contact the Event Organizer.

Your Registration

‍

You accept responsibility for all activities by any person that occur using your registration to access the Service. You may not assign or otherwise transfer your registration to any other person or entity. ETS reserves the right to terminate registrations or refuse or cancel service.

Suspension and Termination

‍

ETS has the right to suspend or otherwise block your current or future use of the Services, or, if applicable, terminate your registration, for any reason or no reason, including without limitation if you violate or fail to comply with any of your obligations or requirements under these TOU or any other agreement with ETS, or pursuant to any ETS policy, including the Privacy Policy.

Children Under Thirteen

‍

ETS does not knowingly collect personal information from persons under 13 years of age. No information should be submitted to the Services by or about persons under 18 years of age.

DISCLAIMERS; LIMITATION OF LIABILITY

‍

THE SERVICES, AND THE MATERIALS, INFORMATION, AND DATA AVAILABLE THROUGH THE SERVICES, ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ETS AND ITS LICENSORS DISCLAIM ALL REPRESENTATIONS AND WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, NOT EXPRESSLY SET OUT IN THESE TOU, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ETS MAKES NO REPRESENTATION, WARRANTY, OR GUARANTEES (I) REGARDING THE RELIABILITY, TIMELINESS, QUALITY, SUITABILITY, OR AVAILABILITY OF THE SERVICES, OR THE MATERIALS, INFORMATION, OR DATA AVAILABLE THROUGH THE SERVICES, OR (II) THAT THE FOREGOING WILL BE ACCURATE, UNINTERRUPTED, OR ERROR-FREE. THE ENTIRE RISK ARISING OUT OF YOUR USE OF THE SERVICES, AND THE MATERIALS, INFORMATION, OR DATA AVAILABLE THROUGH THE SERVICES, REMAINS SOLELY WITH YOU.

IN NO EVENT SHALL ETS OR ITS LICENSORS BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION DIRECT, INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY ADVANTAGE) ARISING OUT OF (I) THE SERVICES, OR THE MATERIALS, INFORMATION, OR DATA AVAILABLE THROUGH THE SERVICES, OR (II) YOUR USE OF OR INABILITY TO ACCESS OR USE THE FOREGOING, OR (III) YOUR RELIANCE ON OR ANY INACCURACY IN THE FOREGOING, OR (IV) ANY TRANSACTION OR RELATIONSHIP BETWEEN YOU AND AN EVENT ORGANIZER OR ANY OTHER THIRD-PARTY, EVEN IF ETS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE THEORY OF RECOVERY. THE SERVICES ARE AVAILABLE FOR YOUR CONVENIENCE ONLY.

NOTWITHSTANDING ANYTHING TO THE CONTRARY, YOUR SOLE REMEDY IN RESPECT OF THE SERVICES, THE MATERIALS, INFORMATION, OR DATA AVAILABLE THROUGH THE SERVICES, THESE TOU, OR THE PRIVACY POLICY, REGARDLESS OF THEORY OF RECOVERY, SHALL BE FOR YOU TO CEASE YOUR ACCESS TO AND USE OF THE SERVICES.

IF ANY PART OF THIS LIMITATION OF LIABILITY IS FOUND TO BE INVALID OR UNENFORCEABLE FOR ANY REASON, THEN THE AGGREGATE LIABILITY OF ETS UNDER SUCH CIRCUMSTANCES FOR LIABILITIES THAT OTHERWISE WOULD HAVE BEEN LIMITED SHALL NOT EXCEED THE LOWEST LIMITATION OF LIABILITY ALLOWED BY LAW, OR, IN THE EVENT SUCH AMOUNT IS NOT PRESCRIBED BY LAW, ONE HUNDRED DOLLARS ($100).

Third Party Services and Content

‍

The Services may be made available to you, or accessed by you, using third party devices, such as mobile devices and applications, and other third-party services and content (including advertising) that ETS does not control. The Services may also include advertisements or otherwise link to third-party websites or other content. You acknowledge that different terms of use and privacy policies apply to your use of such third-party websites and applications (including Event Organizers’ websites and applications), services, or content. ETS does not endorse third-party materials and in no event shall ETS be responsible or liable for any third-party products or services.

Certain brands and logos represented on the website are those of our business partners and do not imply any corporate affiliation with the owners thereof.

Network Access and Devices

‍

You are responsible for obtaining the data network access necessary to use the Services. Your mobile network’s data and messaging rates and fees may apply if you access or use the Services from your device or if you sign up to receive messages or reminders via mobile messaging Services. You are responsible for acquiring and updating compatible hardware or devices necessary to access and use the Services and any updates thereto. ETS does not guarantee that the Services, or any portion thereof, will function on any particular hardware or devices. In addition, the Services may be subject to malfunctions and delays inherent in the use of the Internet and electronic communications.

General

‍

You may not assign these TOU. Any purported assignment shall be void. ETS may assign these TOU, including any portion of or all of the rights set forth herein, without your consent, to any successor in interest of the Services or any portion thereof. These TOU shall continue in effect following termination of your access to and use of the Services or, if applicable, your registration. Any provision of these TOU which by its nature is intended to be applicable following termination or expiration hereof shall survive such termination or expiration. No fiduciary or agency relationship exists between you, ETS, or any third-party as a result of these TOU or use of the Services. If any provision of these TOU is held to be invalid or unenforceable under applicable law, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law. ETS’s failure to enforce any right or provision in these TOU shall not constitute a waiver of such right or provision unless acknowledged and agreed to by ETS in writing. In these TOU, “including” means “including, but not limited to”; and “or” means “and/or”, not “either… or”.
